Terms of Service

1. Agreement to Terms

By accessing or using Wellar.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Wellar.io is a cloud optimization platform that connects to your Amazon Web Services (AWS) accounts via read-only IAM roles to provide cost optimization recommendations, security assessments, reliability checks, and other insights based on the AWS Well-Architected Framework.

3. Account Registration

Access to the Service begins with a request for access. You provide accurate, complete information about yourself and your organization, and we review and approve requests before an account is activated. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. AWS Account Access

The Service requires read-only access to your AWS accounts through a cross-account IAM role. You are responsible for deploying and managing this IAM role in your AWS environment. The Service will only perform read operations and will not modify any resources in your AWS accounts.

5. Subscription Plans and Payment

The Service is offered through the following plans and add-ons:

• Free — free to use while your AWS spend stays under $3,000 per month across up to 3 AWS accounts.
• Architect — for organizations above the Free thresholds. Priced according to your AWS monthly spend.
• WAR Drift Monitor (add-on) — ongoing, human-reviewed monitoring of your Well-Architected posture, priced at 2× your plan price.
• AWS Cost & Well-Architected Audit (one-time) — a one-time engagement priced according to your AWS footprint. See the audit details.

Billing is currently handled via manual invoice. Prices are subject to change with 30 days' notice; changes will not affect your current billing period.

6. Refund Policy

We offer a 14-day money-back guarantee on subscriptions. If you are not satisfied with the Service within the first 14 days of your subscription, contact us at mail@wellar.io for a full refund. After 14 days, subscriptions are non-refundable for the current billing period, and you may cancel at any time and retain access until the end of that period. The one-time AWS Cost & Well-Architected Audit carries its own guarantee under its own terms. See our Refund Policy for full details.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized third parties
• Use the Service to transmit malicious code or interfere with other users
• Resell or redistribute the Service without written permission

8. Intellectual Property

The Service, including its design, features, and content, is owned by Wellar.io and protected by applicable intellectual property laws. Your data remains your property. We claim no ownership over your AWS data or any information processed through the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that recommendations will result in specific cost savings or outcomes. You are responsible for evaluating and implementing any recommendations provided by the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Wellar.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time by contacting mail@wellar.io. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
